Digital Agenda Forum: the challenge of copyright in digital age

Background
In response to the increasing public concern on Internet privacy and the protection of copyright in the digital era, the Commerce, Industry and Technology Bureau launched a new phase of copyright law review in December 2006.  The aim of the consultation exercise is to seek public views on issues related to further strengthening the existing legal protection for copyright, including:

  1. whether criminal liability should be introduced for unauthorized sharing of copyright works,
  2. whether an all embracing right of communicating copyright works to the public should be introduced,
  3. whether any new legal responsibilities should be put on the Online Service Providers for the purpose of combating Internet privacy;
  4. whether a relatively quicker and inexpensive procedure should be provided for copyright owners to facilitate their civil claims against the infringers,
  5. whether statutory remedies should be provided to the copyright owners for alleviation of the burden incurred during proceedings against infringers, and
  6. whether the exemption for temporary reproduction of copyright works should be expanded so as to meet with the operational needs of the Internet Service Providers.

Objective
The principal objective of this event is to bring together the copyright owners, users, ICT industry players such as applications developers, content providers and Internet service providers, as well as the government officials to:

  • understand the views and positions of the stakeholders from different sectors,
  • conduct in-depth discussion on how to strike a reasonable balance between competing interests, and
  • explore opportunities for maintaining regular dialogue and future collaborations between the ICT sector and copyright owners.
